The owner of the online shop www.pintavari.ee (hereinafter referred to as the Online Shop) is Pintaväri Eesti OÜ (registration code 14087832), located at Sära tee 11-4, Peetri alevik, Rae parish, 75312 Harju county.
1 Validity of the sales contract
The terms and conditions of sale apply to the purchase of goods from the Online Shop.
2. Pricing policy
The prices of the products sold in the Online Shop include VAT and are indicated with the products. The price is subject to a delivery charge. The prices and/or availability of goods on the online shop are subject to change without notice. Promotional prices and promotional products/bundles are not subject to additional discounts.
Delivery charges depend on the location of the buyer and the delivery method. The delivery charge will be displayed to the purchaser at the time of placing the order.
Information about the goods is provided on the Online Shop directly next to the goods.
Pintaväri Eesti OÜ has the right to withdraw from the sales contract concluded through the e-shop without any sanctions and to not deliver the ordered goods if the goods are out of stock, if the price or the characteristics of the goods are not displayed correctly due to a system error or if the buyer does not meet the conditions for receiving the service. If the e-shop is unable to fulfil the order, the buyer will be contacted and the amount paid will be refunded.
3 Placing an order
You do not need to register to make a purchase from the online shop. To place an order, you must add the desired products to your shopping cart. In order to place an order, you must fill in the required fields and select the appropriate delivery method. The amount of the fee is then displayed on the screen, which can be paid by bank transfer or other payment method.
The contract will enter into force as soon as the amount due has been credited to the account of the Webshop.
If the ordered goods cannot be delivered due to expiry of the goods or for any other reason, the buyer will be informed as soon as possible and the money paid (including delivery costs) will be refunded, normally within 3 working days. Depending on the method of payment, it may take up to 7 working days to receive the payment.
4 Delivery
Delivery is made to the following countries: Estonia, Finland.
The shipping costs are borne by the purchaser and the corresponding price information is displayed with the shipping method. The price of the goods is indicated in the delivery address and the delivery price is displayed on the invoice. Shipments within Estonia will normally reach the destination specified by the buyer within 3-7 working days from the date of entry into force of the sales contract. International orders might take up to 14 days.
5 Right of withdrawal
After receipt of the order, the Buyer has the right to withdraw from the contract concluded in the e-shop within 14 days (except for specially mixed colour at the request of the Customer).
In order to exercise the right of withdrawal within 14 days, the goods ordered may not be used in any other way than is necessary to ascertain the nature, characteristics and functioning of the goods, in the same way as is permitted for testing the goods in a physical shop.
If the goods have been used for purposes other than those necessary to ascertain the nature, characteristics and functioning of the goods, or if the goods show signs of use or wear, the Online Shop shall be entitled to reduce the refundable amount in accordance with the reduction in the value of the goods.
In order to return the goods, you must submit a withdrawal request by e-mail to info@pintavari.ee no later than 14 days after receipt of the goods. The cost of returning the goods is borne by the buyer, unless the reason for returning the goods is that the goods to be returned do not correspond to what was ordered (e.g. wrong or defective goods). The purchaser must return the goods within 14 days of the date of the application or provide proof that he has handed them over to the carrier within the aforementioned period. Upon receipt of the goods to be returned, the online shop will reimburse to the purchaser immediately, but not later than 14 days after receipt of the request for withdrawal, all payments received from the purchaser under the contract. The online shop may refuse to make refunds until it has received the return of the goods that are the subject of the contract or until the buyer has provided proof that it has returned the goods, whichever is the earlier. If the purchaser has expressly chosen a delivery method other than the cheapest delivery method offered by the Online Shop, the Online Shop is not obliged to reimburse the consumer for the cost that exceeds the cost of the usual delivery method. The online shop has the right to withdraw from the sale and to demand the return of the goods from the purchaser if the price of the goods in the online shop is, due to a mistake, marked significantly below the market price of the goods.
6 Right to file a complaint
The online shop is liable for the non-conformity or defect of the goods sold to the buyer, which already existed at the time of delivery and which becomes apparent within a period of up to two years from the delivery of the goods to the buyer. During this first year after the delivery of the goods to the buyer, it is presumed that the defect already existed at the time of delivery. It is the responsibility of the On-line Shop to rebut this presumption. In the event of a defect, the Buyer has the right to contact the Webshop within two months at the latest by sending an e-mail to info@pintavari.ee. The online shop shall not be liable for defects arising after the delivery of the goods as a result of an act or omission on the part of the consumer (incorrect use, accident, etc.) or in the case of normal wear and tear resulting from normal use of the goods. If the goods purchased from the Webshop have defects for which the Webshop is liable, the Webshop will repair or replace the defective goods. In the event that the goods cannot be repaired or replaced, the Online shop will refund the buyer all the fees that were included in the sales contract. The online shop shall respond to the complaint submitted by the consumer in writing or in a form that can be reproduced in writing within 15 days.
7 Dispute resolution
If the purchaser has any complaints regarding the Online Shop, they should be sent by e-mail to info@pintavari.ee. If the buyer and the Online Shop are unable to settle the dispute by means of an agreement, the buyer can turn to the Consumer Disputes Committee. You can read the terms and conditions of the procedure and submit an application here. The Consumer Disputes Committee is competent to settle disputes arising out of a contract concluded between the buyer and the Online Shop. The examination of the buyer's complaint by the Commission is free of charge. The buyer may refer the matter to the European Union's consumer dispute resolution platform.
